End-User License Agreement (EULA) for STC QB Customs

IMPORTANT: PLEASE READ THIS LICENSE CAREFULLY BEFORE USING THIS SOFTWARE.
1. License
By downloading, installing, or using STC QB Customs (“Software”), the entity or individual entering into this agreement (“Licensee”) agrees to be bound by this agreement (“Agreement”). If you do not agree to the terms of this Agreement, do not install or use the Software.
2. License Grant
Smart Traffic Company, LLC (“Licensor”) grants the Licensee a non-exclusive, non-transferable, limited license to use the Software solely for business use on computers, mobile devices, or other applicable platforms owned or controlled by the Licensee.
3. Restrictions
The Licensee shall not:
- Modify, adapt, translate, reverse engineer, decompile, disassemble, or create derivative works of the Software.
- Resell, sublicense, or otherwise transfer the Software to anyone else without prior written consent from the Licensor.
4. Ownership
The Software is the property of Smart Traffic Company, LLC. The Licensee is granted a license to use the Software, but the Licensor retains all rights, title, and interest in and to the Software, including all associated intellectual property rights.
5. Term and Termination
This Agreement is effective from the date of first use and continues unless terminated by either party.
- The Licensee may terminate this Agreement at any time by ceasing all use of the Software and deleting all copies.
- The Licensor may terminate this Agreement immediately and without notice if the Licensee fails to comply with any term or condition of this Agreement.
6. Disclaimer of Warranty
The Software is provided “as is”, with no warranties whatsoever.
Smart Traffic Company, LLC expressly disclaims to the fullest extent permitted by law all express, implied, and statutory warranties, including but not limited to:
- Warranties of merchantability
- Fitness for a particular purpose
- Non-infringement of proprietary rights
7. Limitation of Liability
Under no circumstances shall Smart Traffic Company, LLC be liable to any user for:
- Direct, indirect, incidental, consequential, special, exemplary, or punitive damages
- Any damages resulting from the use or misuse of the Software
This applies even if Smart Traffic Company, LLC has been advised of the possibility of such damages.
8. General
- This Agreement constitutes the entire agreement between the parties regarding the Software and supersedes all prior or contemporaneous understandings on the subject.
- Any modifications or amendments to this Agreement must be in writing and signed by authorized representatives of both parties.
By installing or using the Software, you acknowledge that you have read this Agreement, understand it, and agree to be bound by its terms and conditions.
